Rubbish Removal West Kensington Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal West Kensington provides rubbish removal and waste collection services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means any rubbish removal, waste collection, clearance, loading, transportation, recycling or disposal service provided by us.

1.2 We, us, our means Rubbish Removal West Kensington, the service provider.

1.3 You, your means the customer requesting or receiving the Service, whether as an individual, business, landlord, tenant, managing agent or other organisation.

1.4 Premises means the property, land or location from which the waste is to be removed or at which the Service is to be carried out.

1.5 Waste means any rubbish, junk, household waste, commercial waste or other materials that you ask us to remove, subject to the exclusions in these Terms and Conditions and applicable waste regulations.

2. Scope of Service

2.1 We provide rubbish removal and waste collection services primarily within West Kensington and surrounding areas, including the collection, loading, transportation and disposal or recycling of Waste in accordance with UK waste legislation.

2.2 The Service may include, where agreed, internal and external clearance, removal from multiple floors, garden or garage clearances, and ad hoc or regular collections.

2.3 We reserve the right to refuse removal of any item or material that we reasonably consider to be hazardous, prohibited, unsafe to handle, not in compliance with applicable waste regulations, or beyond the agreed scope of the booking.

2.4 We are not responsible for cleaning, repair, decorating, or any works other than the collection and removal of Waste, unless expressly agreed in writing as an additional service.

3. Booking Process

3.1 You may request a booking for rubbish removal or waste collection by telephone, email or any other method we make available.

3.2 When making a booking, you must provide accurate and complete information about:

(a) the Premises address and access details;
(b) the type and approximate volume or weight of Waste;
(c) any special handling requirements, such as bulky items, restricted access, stairs or parking constraints; and
(d) your preferred date and time for the Service.

3.3 Any quote provided prior to our arrival is an estimate only, based on the information you supply. We may revise the price on site if the actual volume, weight, type or location of the Waste differs from what was described, or if access is more difficult than reasonably anticipated.

3.4 A booking is only confirmed when we accept it and provide you with confirmation. We reserve the right to decline any booking request at our discretion.

3.5 You must ensure that you or an authorised representative is present at the Premises at the agreed time to confirm the work to be carried out, agree final pricing and make payment as required.

4. Access and Parking

4.1 You are responsible for ensuring that we have suitable access to the Premises at the agreed time, including any necessary keys, codes, permits or authorisations.

4.2 You must ensure that there is adequate parking or stopping space available for our vehicles as close as reasonably possible to the Premises. Any parking charges, fines, penalties or related costs incurred as a result of insufficient or restricted parking arrangements may be added to your final bill.

4.3 If we are unable to gain access to the Premises at the agreed time for reasons within your control, we may treat this as a late cancellation and charge a call-out or cancellation fee in accordance with these Terms and Conditions.

5. Pricing and Payment

5.1 Our prices are generally calculated based on the volume or weight of Waste, type of materials, labour involved, access conditions, and any disposal or recycling charges applicable at the time of Service.

5.2 Any prices quoted prior to collection are estimates only and may be adjusted on site once we have assessed the actual Waste and conditions. You will be informed of any change in price before we commence the Service.

5.3 All prices are stated exclusive of VAT unless expressly indicated otherwise. Where VAT is applicable, it will be charged in addition at the prevailing rate.

5.4 Payment is due in full on completion of the Service, unless we have agreed alternative payment terms in advance. We may accept payment by cash, card, bank transfer or other methods as notified to you.

5.5 For business customers, we may issue invoices with agreed credit terms. All invoices must be paid in full by the due date stated. We reserve the right to charge interest on late payments and to recover any reasonable costs incurred in the collection of overdue amounts.

5.6 We reserve the right to suspend or cancel further services to you if any outstanding amounts remain unpaid.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking by giving us reasonable notice before the agreed arrival time.

6.2 If you cancel more than 24 hours before the scheduled time, no cancellation fee will normally apply, unless we have incurred specific costs on your behalf.

6.3 If you cancel less than 24 hours before the scheduled time, or if we arrive at the Premises and are unable to carry out the Service due to reasons within your control, we may charge a cancellation or call-out fee to cover our time and travel costs.

6.4 We will make reasonable efforts to accommodate changes in date, time or scope, but such changes are subject to availability and may result in a revised price.

6.5 We reserve the right to cancel or reschedule a booking due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents, or regulatory restrictions. In such cases, we will notify you as soon as reasonably practicable and offer an alternative appointment. We will not be liable for any loss arising from such cancellation or delay.

7. Customer Responsibilities

7.1 You are responsible for ensuring that the Waste to be removed is clearly identified and separated from any items you intend to keep. We accept no liability for removing items mistakenly presented as Waste.

7.2 You must inform us in advance of any items requiring special handling, including hazardous waste, electrical equipment, fridges and freezers, mattresses, construction waste or other specialist materials.

7.3 You must ensure that the Premises are reasonably safe for our staff and contractors, including secure flooring, lighting, and clear access routes free from hazards.

7.4 You agree to comply with all applicable laws and regulations relating to the Waste, the Premises and the Service, and to cooperate fully with our staff in the safe and efficient performance of the work.

8. Waste Regulations and Prohibited Items

8.1 We operate in accordance with applicable UK waste management legislation and duty of care obligations. All Waste collected will be transported and disposed of or recycled at authorised facilities.

8.2 We do not accept certain types of hazardous or prohibited materials, which may include but are not limited to:

(a) Asbestos or asbestos-containing materials;
(b) Chemical, biological or medical waste;
(c) Gas bottles, fuel, oils, solvents or explosives;
(d) Certain types of batteries or electronic waste not agreed in advance;
(e) Live animals or biological matter; and
(f) Any other material classified as hazardous or prohibited under relevant regulations.

8.3 If we discover prohibited or hazardous materials among the Waste, we may refuse to remove them, adjust the price to reflect additional handling or disposal costs, or terminate the Service. You may be responsible for any additional charges or liabilities arising from misdescription or non-disclosure of such materials.

8.4 Title to the Waste passes to us upon loading into our vehicle, subject to any applicable laws and provided that the Waste is lawful for us to handle. We may then reuse, recycle, recover or dispose of the Waste at our discretion in accordance with regulatory requirements.

9. Damage and Liability

9.1 We will exercise reasonable care and skill when providing the Service. However, minor scuffs or marks to walls, floors, door frames or other surfaces may occur when removing bulky or heavy items. You acknowledge that a certain level of risk of cosmetic damage is inherent in such activities.

9.2 Our liability for damage to property caused by our negligence will be limited to the reasonable cost of repair or replacement, taking into account fair wear and tear, age and condition of the item or area affected.

9.3 We will not be liable for:

(a) Any loss or damage arising from inaccurate information provided by you;
(b) Any loss of profits, business, contracts, income, goodwill or anticipated savings;
(c) Any indirect or consequential loss or damage; or
(d) Any loss or damage that could not reasonably have been foreseen at the time of the contract.

9.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded.

9.5 You must notify us in writing of any claim for damage or loss as soon as reasonably practicable and in any event within 7 days of the date of the Service, providing reasonable details and evidence. We may not be able to consider claims made outside this period.

10. Insurance

10.1 We maintain public liability insurance and any other mandatory cover required for the provision of rubbish removal and waste collection services in the United Kingdom.

10.2 It is your responsibility to ensure that your own insurance, including any building, contents or business interruption policies, is adequate to cover your property and any items left on the Premises.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible with details of your complaint so that we can investigate and seek to resolve the matter.

11.2 We will handle complaints fairly and promptly and may request additional information or evidence from you to assist in our investigation.

11.3 If a dispute cannot be resolved directly between us within a reasonable period, either party may consider seeking independent advice or using an alternative dispute resolution process. This does not affect your statutory rights.

12. Data Protection and Privacy

12.1 We will collect and process personal information about you only to the extent necessary for the performance of the Service, administration of your booking, and compliance with legal obligations.

12.2 We will take reasonable steps to keep your personal information secure and will not sell or share it with third parties for marketing purposes without your consent, except where required by law or where necessary for the performance of the Service.

13. Force Majeure

13.1 We will not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, acts of God, strikes, civil unrest, war, terrorism, utility failures, road closures or regulatory restrictions.

13.2 In such circumstances, we may suspend the Service for the duration of the event or, where necessary, cancel the Service without liability, subject to any refund of payments already made for services not performed.

14. Variation of Terms

14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or notified to you and will not affect existing bookings already confirmed, unless required by law.

14.2 It is your responsibility to review the current Terms and Conditions prior to making a new booking.

15. Severability

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be severed from the remaining provisions, which shall continue to be valid and enforceable.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service provided.
